3. Use of the portal
homecret.com provides access to a multitude of information, services, programmes or data (hereinafter, “the content”) on the website belonging to Homecret or its licensors to which the USER may have access. The USER assumes the responsibility of use of the portal. Such responsibility extends to any recording that is necessary to access certain services or content. In such record, the USER will be responsible for providing true and legal information. As a result of this record, the USER can be provided with a password for which he shall be liable, committing to make diligent and confidential use thereof. The USER commits to making appropriate use of the content and services (such as chat services, discussion forums or news groups) offered by Homecret through its portal and including but not limited to not using them to (i) carry out unlawful, illegal activities, or those contrary to good faith and public order; (ii) disseminate racist, xenophobic, illegal or pornographic content or propaganda, or that relating to terrorist offenses or attacks against human rights; (iii) cause damage in the physical and logical systems of Homecret, its suppliers or third parties, introducing or disseminating on the network IT viruses or any other physical or logical systems that are likely to cause the aforementioned damage; (iv) attempt to access and, if applicable, use the email accounts of other users and amend or manipulate their messages. Homecret reserves the right to remove any comments and contributions violating the respect or dignity of the person that are discriminatory, xenophobic, racist, pornographic, that attack youth or infancy, public order or security or that, in its opinion, were not suitable for publication. In any case, Homecret will not be liable for the opinions expressed by users through forums, chats or other participation tools.
4. Data protection
Homecret complies with the guidelines of Organic Law 15/1999 of 13th December governing Personal Data Protection, Royal Decree 1720/2007 of 21st December that approves the Development Regulations of the Organic Law and other regulations in effect at all times, and aims to guarantee the correct use of the user’s personal data. To do so, along with each personal data collection form, in any services the user may request from Homecret, the user will be informed of the existence and acceptance of the particular conditions of the use of his data, in each case informing him of the responsibility of the file created, the address of the person responsible, the possibility of exercising their rights of access, rectification, cancellation or opposition, the purpose of the use and the communications of data to third parties, if applicable. Homecret, on its own behalf or as assignee, is the holder of all the intellectual and industrial property rights of its website, as well as the elements contained therein (including, but not limited to images, sound, audio, video, software or texts, brands or logos, colour combinations, structure and design, selection of materials used, computer software required for its operation, access and use, etc.), ownership of Homecret or its licensors. All rights reserved. By virtue of the provisions of Articles 8 and 32.1, Paragraph Two of the Intellectual Property Law, the reproduction, distribution and public communication, including the modality of provision, of the entirety or part of the content of this website, for commercial purposes, are expressly prohibited in any support and by any technical medium without the authorisation of Homecret. The USER commits to respect the intellectual and industrial property rights of the ownership of Homecret. The elements of the portal may be displayed and even printed out, copied and stored in the hard drive of your computer or in any other physical support provided which is solely and exclusively for personal and private use. 6. Exclusion of warranties and liability
Homecret is in no event liable for any damage or harm of any kind that could occur, including: errors or omissions in the content, lack of availability of the portal or the transmission of viruses or malicious or harmful software in the content, despite having adopted all the technological measures required to prevent it.

10. General points

12. Applicable legislation and jurisdiction
The relationship between Homecret and the USER shall be governed by current Spanish regulations and any dispute shall be submitted to the courts of the city of Madrid.
